By law, short-term employment is limited to 70 days per year or per general agreement . The background to this limitation is the original use of this form of employment in seasonal work.
It also does not matter how many hours a shift contains. In general, the following always applies: One shift = One day out of the 70 days.
Since the 70-day rule applies to a calendar year as well as to the general agreement, this may result in you reaching the 70 days within the general agreement before the 70 days have been reached in a calendar year.
After a short-term general employment agreement is terminated, by law, there must be a two-month break before another general agreement is signed.
A new general agreement after the two-month break/ reaching 70 days is only possible for students.
The following serves as an example of the 70-day rule:
You sign your general agreement with Zenjob in July 2020.
You work 70 shifts by March 2023, 35 of them within 2021.
In this case, the general agreement ends before the actual expiration date after one year (here: before July 2021) and the two-month break starts after your 70th shift.
After the break, you could now work the remaining shifts (70 shifts o2021 minus the 35 shifts you have already worked in 2021 = 35 shifts for the remainder of 2021) with a new general agreement.
If you work more than 70 days, both employer and employee must pay retroactive social contributions for the 70 days already worked. These are amounts between 1000 and 2000 euros. It is therefore very important that you do not exceed the 70 days.
Attention: The 70-day limit applies to all employers, i.e. if you have one (or more) other short-term jobs, the days worked in all short-term jobs are added together. It is therefore very important that you always inform us about the days worked in another short-term employment. We will then update your profile with the days worked in another short-term-employment.
In general, it is your duty to keep track of the number of days worked and to inform Zenjob about other short-term employment, so that you do not exceed the allowed 70 working days of short-term employment.
